These documents apply to the Ecstia educational ERP platform, institution websites powered by Ecstia, and branded mobile applications distributed to students, parents, guardians, and staff.
These Terms of Service ("Terms") govern access to and use of Ecstia's website, educational ERP platform, institution websites, APIs, and mobile applications (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
If you use the Services on behalf of an educational institution, you represent that you have authority to bind that institution to these Terms and any applicable commercial agreement.
Ecstia provides a multi-tenant educational ERP platform that may include, depending on the institution's subscription:

Ecstia and subscribing institutions may monitor usage for security, compliance, and support within applicable law.
Institution mobile apps are distributed through the Apple App Store and Google Play Store and connect to the institution's Ecstia ERP tenant. Use of the mobile app is also subject to the applicable app store terms. The institution's branding, enabled modules, and user permissions determine what data and features are available in the app.
Push notifications, offline views, and device permissions are provided to support institutional workflows. You may disable notifications through your device settings. Ecstia may release app updates to improve security, compatibility, and functionality.
Institutions subscribe to Ecstia under license-based or commercial plans described on our website or in a separate order form. Fees, billing cycles, and renewal terms are defined in that agreement. End users such as students and parents generally access the Services through their institution and do not pay Ecstia directly unless explicitly stated.
Online fee payments are processed through payment gateways configured by the institution. Ecstia is not responsible for payment processor outages, chargebacks, or gateway-specific terms.
Ecstia and its licensors own all rights in the platform, software, documentation, designs, trademarks, and website content, except for institution-provided content and data. Institutions retain ownership of their data, logos, and materials uploaded to the Services.
Subject to these Terms and the institution's subscription, Ecstia grants a limited, non-exclusive, non-transferable right to access and use the Services for internal educational and administrative purposes.
Our collection and use of personal information is described in the Privacy Policy. By using the Services, you acknowledge that you have read and understood that policy.
The Services may integrate with third-party payment gateways, messaging providers, video classroom tools, and other services. Ecstia does not control third-party services and is not liable for their acts or omissions. Your use of third-party services is governed by their respective terms and policies.
We strive to maintain reliable Services but do not guarantee uninterrupted or error-free operation. Maintenance, upgrades, and events beyond our reasonable control may cause temporary downtime. Ecstia may modify features, modules, or interfaces with reasonable notice where practicable.
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Institutions are responsible for verifying reports, certificates, and financial figures before official use.
To the fullest extent permitted by law, Ecstia and its affiliates, officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from or related to the Services. Our aggregate liability for direct damages shall not exceed the fees paid by the institution to Ecstia for the Services in the twelve (12) months preceding the event giving rise to the claim, except where liability cannot be limited under applicable law.
Institutions agree to indemnify and hold harmless Ecstia from claims arising out of the institution's data, configuration, misuse of the Services by its users, violation of law, or breach of these Terms, except to the extent caused by Ecstia's gross negligence or willful misconduct.
Institutions may terminate service according to their commercial agreement. Ecstia may suspend or terminate access for breach of these Terms, security risk, or non-payment. Upon termination, access to the Services and mobile apps may cease, and data handling will follow the institution's contract and applicable law.
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a separate written agreement with the institution specifies otherwise. Courts in India shall have exclusive jurisdiction over disputes arising from these Terms, except where mandatory consumer protection law provides otherwise.
We may revise these Terms from time to time. The "Last updated" date indicates the current version. Continued use of the Services after changes take effect constitutes acceptance. Material changes may be communicated via the website or in-product notice.
